The Broadmoor’s Golden Bee Design Contest

Official Rules

MUST BE A CUSTOMER TO ENTER OR WIN. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING. YOUR ENTRY INTO THIS CONTEST IS SUBJECT TO THE FOLLOWING TERMS, CONDITIONS, LIMITATIONS, AND OTHER RULES (THE “OFFICIAL RULES”). BY ENTERING THIS CONTEST, YOU (“ENTRANT”) SIGNIFY YOUR ACCEPTANCE OF THESE OFFICIAL RULES.

Administrator: The Broadmoor’s Golden Bee Design Contest (the “Contest”) is administered and sponsored by The Broadmoor Hotel, Inc. (“Administrator,” “us,” “our,” or “we”).

Eligibility: The Contest is open only to legal residents of the United States and the District of Columbia who are at least eighteen (18) years old.  Employees of Administrator and its respective affiliates, subsidiaries, and other related companies (collectively, the “Contest Entities”), as well as the immediate family (spouse, parents, siblings, and children) and household members of each such employee are not eligible to participate in the Contest. The Contest is subject to all federal, state, and local laws and regulations. Participation constitutes Entrant’s full and unconditional agreement to these Official Rules and Contest Administrator’s decisions, which are final and binding in all matters related to the Contest. Odds of winning a prize in this Contest depend on the number of eligible entries received during the Promotion Period. Void in Puerto Rico, all U.S. territories and possessions not listed herein, overseas military installations, and where prohibited or restricted by law.

Timing: The Contest begins at 11:30 a.m. Mountain Time (“MT”), June 1, 2021, and ends at 11:59 p.m. MT, July 31, 2021 (the “Promotion Period”).

How to Enter: During the Promotion Period:

i. Obtain an entry form at The Golden Bee;
ii. On the entry form, create a design meeting the Design Criteria for a Golden Bee sticker as described below; and 
iii. Submit your entry form by any of the following:

a. In person at The Golden Bee
b. Email to Marketing@Broadmoor.com
c. Mail to: The Broadmoor, Attn: Marketing, 1 Lake Avenue Colorado Springs, CO 80906.

No limit on the number of entries per person, however, each entry must be unique.
 
Design Criteria: Each design must be comprised 100% of your original work, and may not include any intellectual property of any third party. All designs must be suitable for a family audience, and may not be offensive in any manner, as determined by Administrator in its sole discretion.

For all entries: All entries must be received during the Promotion Period. By submitting your entry in the Contest, you transfer to Administrator all right, title and interest, including without limitation all trademark rights, rights of copyright, and all other intellectual property or proprietary rights, you may have in your entry submission, including all drawings, images, graphics, text, and other content contained within your entry (collectively, your “Entry Submission”) and all moral rights therein.  Administrator, as the owner of all intellectual property rights in the Entry Submission, reserves the right to modify the Entry Submission, create derivative works thereof, without any notice to you and without your approval.  You further hereby  grant Administrator a perpetual, irrevocable, worldwide, transferrable, sublicensable, right and license to display, reproduce, adapt, distribute, perform, create derivative works of, and otherwise use, your Entry Submission together with your name and biographical information or other information you submitted together with your Entry Submission, for the purpose of promoting the Contest on social media, as well as via email and through other channels, and also for use in connection with the promotion of the Broadmoor’s Golden Bee restaurant, for promotional purposes related to the Broadmoor or its properties, or for any other purpose whatsoever, commercial or otherwise, without any notice or compensation to you. Only one person’s name may be submitted with each Entry Submission, even if more than one person has collaborated in the creation thereof.  Entries received with multiple names may be disqualified in Administrator’s discretion.  No Contest entries will be acknowledged or returned. Proof of submission will not be deemed to be proof of receipt by Contest Administrator. Contest Administrator is not responsible for lost, late, incomplete, invalid, unintelligible, or otherwise non-conforming entries, each of which will be disqualified.

Judging Criteria: Contest entries received will be judged as follows. Following the end of the Promotion Period, Administrator will select a panel of four (4) individuals (the “Judging Panel”), who will review all Contest entries and will allocate points to them based on the following criteria:  fifty percent (50%) on creativity, and fifty percent (50%) based on reflecting the image and traditions of the Golden Bee (the “First Round Judging Criteria”).  On or about August 4th, 2021 the Judging Panel will select at least three (3) but no more than five (5) entries as the “Finalists” based on the First Round Judging Criteria.  Administrator will then post the Finalists on its Facebook account, and will ask visitors to its Facebook page to choose their favorite.  On or about August 13th, 2021 Administrator will tally the votes received for the Finalists from its Facebook page, and will then determine, based on the following criteria (the “Second Round Judging Criteria” one (1) entry as the winner:  twenty-five percent (25%) on creativity,   twenty-five percent (25%) on reflecting the image and traditions of the Golden Bee, and fifty percent (50%) on popularity based on voting from Facebook.

Entrants selected must comply with all terms and conditions of these Official Rules, and winning is contingent upon fulfilling all requirements. Any potential winner shall be subject to verification by Administrator, whose decisions are final and binding in all matters related to the Contest. If requested, and except where prohibited, potential winner must sign and return to Administrator, within ten (10) business days of being notified, an affidavit of eligibility and liability/publicity release in order to claim his/her prize. If a potential winner is discovered to be ineligible for the Contest, or if he/she fails to sign and return the completed affidavit of eligibility and liability/publicity release within the required time period, an alternate Entrant will be selected in his/her place at random from among all eligible entries received.

Prizes: One (1) Prize will be awarded in this Contest.

Prize description and limitations: The prize consists SOLELY of a gift card to the Golden Bee in the amount of five hundred dollars ($500). No substitute prizes will be available.

Total Approximate Retail Value (“ARV”) of the prize: $500.00.

Release: By receipt of any prize, winner agrees to release and hold harmless the Administrator, Facebook, and their respective parent companies, subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies, and prize suppliers, and each of their respective parent companies and each such company’s officers, directors, employees, and agents (collectively, the “Released Parties”) from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Contest or receipt or use or misuse of any prize.

General Conditions: This promotion is in no way sponsored, endorsed, or administered by, or associated with, Facebook. You understand that you are providing your information to the Administrator and its affiliates and not to Facebook.  Administrator reserves the right to cancel, suspend, and/or modify the Contest, or any part of it, if any fraud, technical failures, or any other factor impairs the integrity or proper functioning of the Contest, as determined by Administrator in its sole discretion, and Administrator disclaims any liability for such events. If terminated, Administrator may, in its sole discretion, determine the winners from among all non-suspect, eligible entries received up to time of such action using the procedure outlined above. Administrator, in its sole discretion, reserves the right to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of the Official Rules or in an unsportsmanlike or disruptive manner and void all associated entries. Any attempt by any person to deliberately undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and, should such an attempt be made, Administrator reserves the right to seek damages and other remedies (including attorneys’ fees) from any such person to the fullest extent permitted by law. Administrator’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. Administrator further reserves the right to cancel, terminate, or modify the Contest if it cannot be conducted, operated, or completed as planned for any reason.

Limitations of Liability: Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by Entrant, printing, typographical, or other errors or by any of the equipment or programming associated with or utilized in the Contest; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone/internet lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Contest; (4) printing, typographical, technical, computer, network, or human error which may occur in the administration of the Contest, the uploading, the processing, or selection of entries, the announcement of finalists or the Contest Winner, or in any Contest-related materials; (5) late, lost, undeliverable, faulty, or damaged entries or private messages; or (6) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from Entrant’s participation in the Contest or receipt or use or misuse of any prize. Released Parties are not responsible for misdirected or undeliverable entries or for any technical problems, malfunctions of computer systems, servers, providers, hardware/software, lost or unavailable network connections, or failed, incomplete, garbled, or delayed computer transmission or any combination thereof. Released Parties are not responsible for any unauthorized third party use of any entry.

Disputes: Entrant agrees that: All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, or the rights and obligations of Entrant(s) and Administrator and their agencies, shall be governed by and construed exclusively in accordance with the laws of the State of Colorado without giving effect to any choice of law or conflict of law rules which would cause the application of the laws of any jurisdiction other than the State of Colorado.  Entrant agrees that any action at law or in equity arising out of or relating to this Contest, or awarding of the prize, shall be filed only in the state or federal courts located in the State of Colorado. Entrant hereby consents and submits to the personal jurisdiction of such courts for the purposes of litigating any such action.  Except where prohibited, by participating in this Contest, Entrant agrees that: (a) any and all disputes, claims, and causes of action arising out of or connected with this Contest, or awarding of the prize, shall be resolved individually, without resort to any form of class action; and (b) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with participating in this Contest but in no event attorneys’ fees; and (c) under no circumstances will any participant be permitted to obtain awards for and hereby waives all rights to claim punitive, incidental, and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.  Some jurisdictions do not allow the limitations or exclusion of liability for incidental or consequential damages, so the above may not apply to you.
